Gov. Greg Abbott of Texas thinks he can just sign legislation into law like Trump does Executive Orders and the people of Texas will throw praise upon him. That would be the GOP of Texas.
However, not only has the #Resistance found their voice, but one thing Abbott seems to forget is that the ACLU always has the underdogs back! Wether it’s LGBTQ issues, Race Issues, Immigrants Issues, Special Needs issues for public education or a long list of other problems in Texas the ACLU is always there to fight back!
As I stated in a previous article, the Federal Western District in San Antonio, which covers Austin and Travis County, has set the date for the temporary injunction halting SB 4 “Sanctuary City-Show Me Your Papers” law and consolidated the lawsuits from the major cities in Texas accelerating the date of the hearing to June 26th.
In a recent article in The Texas Observer the American Civil Liberties Union (ACLU) stated it is sending Attorney Lee Gelernt and four other attorneys who successfully fought the travel ban to the Lone Star State.“SB 4 and the travel ban cases raise different technical legal issues, but both arise in, and are part of, an unfortunate anti-immigrant climate,” Gelernt told the Observer. “Both laws rest on incorrect and pernicious stereotypes.” He went on to say the ACLU is devoting national resources to fighting the state law “because of the national importance, given that states around the country are talking about similar laws.”
Critics call SB4 the “Show-Me-Your-Papers” law because it allows law enforcement to question the immigration status of anyone who has been lawfully arrested or detained. In addition, it could punish cities, counties and universities who do not enforce the law. Also, police chiefs, county sheriffs, constables and city and county officials who do not enforce the law could face criminal charges, and local jurisdictions could be fined up to $25,000 per violation per day. SB 4 is set to go into effect on September 1st.
I know the ACLU is sending the best of the best. They have been happy to speak out against the discrimination that SB 4 will create in Texas and also about the unconstitutionality of this law.
As far as Texas Attorney General Ken Paxton, well, he is not saying a word. When he was asked to speak about the lawsuit he just used his standard answer of “we do not comment on ongoing litigation.” Surprise surprise!
Paxton did file a preemptive lawsuit against the City of Austin, Mayor Adler, Austin City Council, Sheriff Hernandez and Travis County and MALDEF (Mexican American Legal Defense and Educational Fund). This frivolous lawsuit, filed on May 7th, most likely will never see the light of day since the lawsuit on SB 4 will take place on June 26th. I love the statement that MALDEF made at the end of their statement regarding Paxton’s lawsuit where they said “We will see you in court, Governor Abbott. In the meantime, we hope that both the governor and the attorney general will seek treatment for an apparent problem with premature litigation.” An EXCELLENT response to this RIDICULOUS lawsuit!
